Helping Injured Drivers in Jefferson County Seek Compensation

Truck drivers spend more time on the road than most other people do. As a result, their chances of being involved in an accident are much higher.

The workers’ compensation system is designed to provide benefits to employees who suffer injuries during the course and scope of their employment.

This applies to a wide variety of truck drivers including:

  • Long-haul drivers
  • UPS and FedEx deliverers
  • Taxi and shuttle drivers
  • Construction and landscaping crews
  • Dump truck drivers
  • Heavy equipment operators

If you have been injured while operating a truck on the job, you may be entitled to benefits. Filing a Workers’ Compensation Claim in Alabama

The workers’ compensation system provides benefits for injured employees in a variety of circumstances and regardless of fault. If you were harmed in an accident, while loading or unloading the truck, or while climbing in or out of the vehicle, your injuries are compensable.

The first thing you must do to pursue benefits is to file a claim with your employer’s workers’ compensation insurer. Next, the insurance company will likely request that you undergo a medical examination to determine the nature and extent of your injuries. Under Code of Alabama, 1975 §25-5-77(b), this is referred to as an independent medical examination or IME. The doctor conducting the IME must be a physician who has not previously treated you for the same complaint and who is not your family physician.

During the exam, the IME doctor will determine whether your injury is total or partial and whether it is temporary or permanent. The examination will also involve questions regarding your prior medical history and any other medical conditions that you may have. The physician will then determine the appropriate course of treatment for you.

Pursuing Benefits

The amount of benefits that you may receive depends on the nature and scope of your injury. These financial benefits will cover medical expenses as well as any missed wages associated with the injury. Depending on the type of injury you suffered, you may be required to forgo getting behind the wheel until you have recovered. If you suffered an injury that is partial and temporary, you will receive a lesser level of benefits than if your injury was total and permanent. In the latter case, you may be entitled not only to workers’ compensation but also to disability benefits.

In the event your workers’ compensation claim is denied, you can file an appeal to challenge the determination. There are certain time limits that apply to an appeal, so it is important to act quickly.
