Chapter 7 vs Chapter 13 Bankruptcy
For most people experiencing significant financial struggles, there are two main types of bankruptcy available: Chapter 7 and Chapter 13. Chapter 7 is commonly referred to as “fresh start” bankruptcy, while Chapter 13 is known as a bankruptcy repayment plan. When you enter either type of bankruptcy, you will receive immediate protection against collection efforts and wage garnishments from creditors.
In Chapter 7 bankruptcy, most – if not all – debt is discharged, except for recent taxes, unpaid child support, and student loans. While it is possible you could lose your home and/or vehicle, you can keep most of your property. Chapter 7 works well for individuals who do not own a lot of property, as well as those who are dealing with credit card debt, personal loans, and unpaid medical bills.
However, not everyone is eligible for Chapter 7 in Alabama. Your household’s income needs to pass the “means test.” In other words, your income must be lower than the state’s median. If your household’s income is higher than the median, then you may still qualify for Chapter 13.
Although the Chapter 13 repayment plan does not discharge debt like in Chapter 7, the amount is reduced to a payable sum. You may also keep both exempt and nonexempt property. The repayment plan typically lasts between three to five years, which is much longer than the three to six months it takes to complete a Chapter 7 bankruptcy.

Birmingham Criminal Defense Attorney Mr. Ingram is a native of Birmingham, Alabama. After earning his Bachelor’s Degree from Samford University, he worked for Alabama Power in Corporate Accounting. Mr. Ingram earned his law degree from Birmingham School of Law in 2002. While attending law school, Mr. Ingram worked as a law clerk in the Office of District Attorney for the Tenth Judicial Circuit in Jefferson County, Alabama.
